Where The Rules Stand For Highfields

Highfields is in the Toowoomba Regional Council area, and the council has said publicly that it has heard community concern about the extent of vegetation removal there. The rules are being reviewed, so what applies depends on what you’re doing.

Situation What we found What to check
Removing a tree from your own block, with no development planned The council’s own tree page says its planning scheme doesn’t require approval to remove significant vegetation where no development is proposed. State rules on protected plants and native vegetation can still apply. The home page has the details.
Clearing tied to building, subdividing or other development The Highfields, Meringandan and Meringandan West Local Plan Code applies to assessable development in its area. In the version dated 28 November 2022, one outcome is that development in the Cooby Creek Reservoir catchment doesn’t adversely affect the quantity or quality of inflows. Ask the council whether your block is in that catchment. The current scheme, version 29, took effect on 21 July 2026, so confirm the wording.
Mapped areas of ecological significance In September 2024 the council endorsed developing a Temporary Local Planning Instrument to protect them, subject to State Government approval. We haven’t confirmed that one is in force. Ask the council before clearing mapped vegetation.
The next planning scheme A council news item from June 2026 says formal public consultation on the draft is expected between February and April 2027, subject to State Government approval. A community campaign says the draft is expected to include tree protections, but we haven’t seen it. Check the council’s position again before large clearing.

For a bushy block, or any larger clearing in Highfields, ask the council for its current position before work starts. These rules have been changing, and what applied last year may not apply now.

Council park trees

Peacehaven Botanic Park, at 56 Kuhls Road, is maintained by the council with the Friends of Peacehaven Botanic Park. Park and street trees are protected by Local Law 1, and pruning or removing them without the council’s written permission is an offence.

Clearing for a build or subdivision

The council has said its review of the planning scheme will look at ways to better manage vegetation under threat from urban encroachment. If your clearing is part of an application, ask which codes apply. How a local plan code works is outlined on our Glenvale page.
